Although the Indian government has declared its intent to move towards a unified taxation system by introducing GST, the current reality of India’s federal structure of government is that while excise duties, corporate and personal income tax rates are uniform across the country, sales tax, octroi and other levies do vary between States.

Tax rates and compliance requirements also depend on legal status of the corporate entity and nature of permanent establishment in India. Further, certain industries enjoy specific tax exemptions provided they fulfil the stipulated conditions. Some of the tax rates and regulations are also subject to change each year under the provisions of the Union/State budgets

The existence of Double Tax Avoidance Agreements (DTAA) with several countries means that in the event of cross-border taxation matters, the applicability and provisions of the relevant DTAA need to be studied carefully before determining the best course of action.
