On September 15, 2023, the Athletics Integrity Unit (AIU) filed an appeal before the Court of Arbitration for Sport (CAS) challenging the decision holding that there was no Anti-Doping Rule Violation (ADRV) on the part of the Nigerian track and field athlete, Tobi Amusan.
The athlete stood accused of committing three whereabouts failures within a span of 12 months. The matter was heard by the independent Disciplinary Tribunal which deals with all first instance disciplinary cases under the World Athletics Anti-Doping Rules or the World Athletics Integrity Code of Conduct. In its decision dated August 17, 2023, the Tribunal had cleared Amusan of charges of whereabouts failures.
Thereafter, the AIU had issued a press release lifting the provisional suspension and citing its inclination to assess the reasoning and exercise the right to appeal.
